1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the ResumaryAI website, applications, and services (collectively, the "Service") operated by Beijing Xilin Technology Co., Ltd ("we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

2. Description of Service

ResumaryAI provides an AI-powered job application assistant that helps users optimize resumes, generate cover letters, track applications, prepare for interviews, and research companies. The Service is hosted on infrastructure provided by Vercel and uses Supabase for authentication and data storage. AI features are powered by third-party models (including, at present, DeepSeek v3.2 via Tencent Cloud); we may add or change AI providers from time to time.

The Service uses a credits-based usage system. Each AI operation (e.g. JD analysis, resume optimization, ATS scoring, cover letter generation, interview preparation, company research) consumes a defined number of credits. Your monthly credit allowance depends on your subscription plan (Free, Basic, or Pro). Credits reset at the start of each calendar month. Features, credit costs, and plan limits may change; we will give you advance notice of material changes where reasonably practicable.

3. Account and Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent that you meet this requirement and have the authority to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any way that violates applicable laws or regulations;
  • Submit false, misleading, or fraudulent information (including in resumes or job applications);
  • Infringe any intellectual property, privacy, or other rights of any third party;
  • Attempt to gain unauthorized access to the Service, other accounts, or our or our providers' systems;
  • Attempt to circumvent credit limits, manipulate credit balances, or abuse the credits system;
  • Use the Service to distribute malware, spam, or harmful content;
  • Resell, sublicense, or commercially exploit the Service except as expressly permitted by us;
  • Use automated means (e.g. scraping, bots) to access the Service without our prior written consent.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.

5. Credits, Payment, and Subscriptions

Credits system: The Service operates on a credits-based model. Free accounts receive 50 credits per month, Basic accounts 1,000, and Pro accounts 3,000. Each AI operation consumes a specified number of credits. Credit costs for each operation are displayed in the Service (e.g. on the pricing page and in the sidebar). If your remaining credits are greater than zero but less than the cost of an operation, we allow a final "grace" use and set your balance to zero. Once your credits reach zero, further AI operations are blocked until the next monthly reset or an upgrade.

Monthly reset: Credits reset to your plan's allowance at the start of each calendar month. Unused credits do not roll over.

Payment providers and Merchant of Record: Paid subscriptions are processed by an authorized third-party payment provider. The applicable payment provider and/or merchant of record for your transaction is clearly identified during checkout and in your payment receipt.

Payments: By subscribing to a paid plan, you authorize the applicable payment provider to charge your selected payment method and you agree to that provider's applicable terms and privacy policy presented at checkout. We do not store full payment card numbers. Pricing is displayed in the currency applicable to your region at the time of purchase. Prices may change; we will give advance notice of price changes affecting your existing subscription where required by applicable law.

Immediate access: Upon subscribing to a paid plan, you will have immediate access to the Service's features and credits. By proceeding with the purchase, you consent to the immediate provision of digital content and acknowledge that access to the Service begins immediately upon successful payment.

Subscriptions renew automatically at the end of each billing period (e.g. monthly or annually) unless you cancel before the renewal date. You may cancel from your account settings and/or the applicable payment provider's customer portal (as shown in your billing emails or receipt). Cancellation stops future charges but does not automatically refund the current period.

6. Refund Policy

We offer a 30-day money-back guarantee on all paid subscriptions. If you are not satisfied with your purchase for any reason, you can request a full refund within 30 days of the purchase date.

How to request a refund: To request a refund, contact us at help@resumaryai.com with your account email and order reference. Where required, we may direct you to the applicable payment provider's support portal shown on your receipt. Approved refunds are issued to your original payment method by the applicable payment provider. Processing times vary by provider and bank and may take up to 10 business days (or longer in some regions).

After a refund: Once a refund is issued, your plan will be changed to Free and any remaining paid credits will be reset. You will continue to have access to the Free plan.

7. AI-Generated Content

Parts of the Service use artificial intelligence (currently including DeepSeek v3.2 and potentially other models in the future) to generate or suggest content (e.g. resume text, cover letters, interview tips, company research summaries). Such content is for assistance only and may be inaccurate, incomplete, or unsuitable. You are solely responsible for reviewing, editing, and ensuring the accuracy and appropriateness of any content you use (including in job applications). We do not guarantee that AI output will meet any particular standard or outcome, and we are not liable for decisions you make based on it.

8. Intellectual Property

We (or our licensors) own all rights in the Service (including software, design, and branding). We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business use in accordance with these Terms. You retain ownership of the content you upload (e.g. resumes, job descriptions); you grant us the rights necessary to operate the Service (e.g. to store, process, and display your content and to use AI providers as described in our Privacy Policy).

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data, including in the European Economic Area (EEA) and the United States.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE ACCURACY OF JOB LISTINGS, EMPLOYER ACTIONS, OR OUTCOMES OF YOUR JOB APPLICATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED US DOLLARS (USD 100), IF GREATER).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations apply to the fullest extent permitted by law.

12. Indemnity

You agree to indemnify, defend, and hold harmless Beijing Xilin Technology Co., Ltd and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your content or conduct, (c) your violation of these Terms or applicable law, or (d) any dispute between you and a third party relating to the Service.

13. Termination

You may stop using the Service and close your account at any time. You can delete your account from the Settings > Privacy & Data page, which permanently removes your profile, resumes, applications, and all associated data. We may also suspend or terminate your access or account if you breach these Terms, for operational or legal reasons, or otherwise at our discretion (with notice where reasonably practicable). Upon termination, your right to use the Service ceases and any remaining credits are forfeited. Sections that by their nature should survive (including 7-12 and this sentence) will survive termination.

14. Governing Law and Disputes

For users in the European Economic Area (EEA), United Kingdom, or Switzerland: These Terms are governed by the laws of the country in which you reside. You may also have the right to bring a claim in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

For users in the United States and elsewhere: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

If you are a consumer in the EU, you may use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.
